A MAN who tried to stop his brother from attacking their mother paid with his life after being struck on the head with an axe, a court heard.

Elliot Mudenda, 23, appeared before a Binga magistrate on Tuesday charged with the Independence Day murder of his brother, Ian.

Prosecuting, Bruce Maphosa told the court how younger brother Elliot, from the Gwata Gwata area of Lusulu in Binga, flew into a rage after being admonished by their mother, Jessie Mudimba.

In the heat of the dispute, Ian intervened trying to calm his brother down.

It is alleged Elliot armed himself with an axe and struck his brother once on the head with the back of the axe. He fell down, but Elliot allegedly struck him several times more until he died.

“Elliot ran away from the scene but villagers apprehended him on the following day and handed him over to the police,” Maphosa told magistrate Stephen Ndhlovu.

He was remanded in custody to May 10, and will stand trial at the High Court.
