Air Force chief sued for adultery by cop

AIR Vice Marshal Elson Moyo, a senior Air Force of Zimbabwe Commander is caught in a messy love triangle with a Chitungwiza-based police officer who alleges he plied his wife with gifts and made her abandon their matrimonial home.

Moyo, who is being sued for adultery by Chitungwiza cop, Charles Murambiwa Chideu, had his special plea dismissed by a Chitungwiza magistrate on Thursday.

Moyo had pleaded with the court to dismiss the issues raised by Chideu in a pre-trial conference saying they were not laid in the summons served to him, but magistrate Geofrey Gogo threw out the application.

"The special plea raised by the defence that the summons does not disclose the cause of action is hereby dismissed since a cause of action is actually laid by the summons.

"The matter should thereby proceed for trial," ruled the magistrate.

Moyo reportedly took advantage of being Prisca Muchaneta Chideu's boss and enticed her with gifts and perks that she did not deserve at work, before entering into the adulterous relationship.

Late in January this year, Murambiwa Chideu filed a lawsuit in which he demanded $3 million for Contumelia (wounded feelings) and $2 million for damages for alienation of affection, comfort, companionship and services.

Chideu is married to Muchaneta Prisca Chideu nee Muzanenhamo, who is employed by the Air Force of Zimbabwe and works in Moyo’s office as his personal assistant.

In his lawsuit Chideu alleges that Moyo allocated his wife a flat, provided transport for her to carry property from their matrimonial home without his knowledge or consent.

He also alleges that when he made follow-up to Manyame Airbase and used his mopbile phone to contact Moyo, he threatened him with arrest if he entered the base, seriously alleging it was a cantonment area.

Chideu also claims that when he approached his in-laws in accordance with customary practices, his wife returned to the matrimonial home with the property save for a freezer.

Chideu claims that even after the resolution of their marriage, Moyo would continue to interfere.

Chideu alleges that on the basis of the events he may not be far from the truth to suggest that his wife may have been engaged in an extra-marital affair with Moyo, considering the intimate relationship between members of an uniformed force separated by such wide disparity in terms of ranks.

He further alleges that he returned from Ntabazinduna Training depot in Bulawayo after a tour of duty only to discover that his wife had once again left home and wiped out all the matrimonial property.

Chideu instituted legal action for a spoliation order for the return of the property to the matrimonial home and an order was granted but she failed to comply and a warrant of arrest was granted and she was detained at Mabvuku police station.

Moyo interfered with the legal process once again, contacting a Senior Assistant Commissioner at Police General Headquarters (name supplied) and the then Officer Commanding Harare Province personally drove to Mabvuku to have Muchaneta released, alleges Chideu.

Chideu claims that the Messenger of Court has failed to recover the propertry from Manyame Airbase where Chideu’s wife is residing in the house she was allocated.

Through his lawyers Mtetwa and Nyambirai legal practitioners, Air Vice Marshall Moyo said that Chideu's evidence was argumentative in nature and does not comply with the rule of suing.

He denied having a relationship with his wife arguing that he only knew her as an employee of Airforce of Zimbabwe.

Air Vice Moyo denied the averments made, and pleads that if Chideu's wife deserted him, this was wholly done by his wife without his involvement or encouragement.

He also argued that he has no knowledge of the movements of Chideu’s wife or actions.

Mtetwa and Nyambirai legal practitioners also said that their client denies interfering with Chideu’s wife, neither does he have knowledge of any permanent desertion from their matrimonial home.

Air Vice Marshal Moyo also denied having helped Chideu’s wife to relocate or harbouring her. He said that he did not play a role in Chideu’s marital problems and he does not know whether or not Chideu has alienated affection and other marital rights.
