Top radio personality escapes jail over maintenance

TOP broadcaster Davies Mugadza on Friday escaped jail by a whisker after he was convicted of flouting the Maintenance Act.
The 39-year-old DJ sired a son with his former girlfriend, Vimbainashe Ngara, in 1999.
Mugadza neglected to maintain his child resulting in Ngara dragging him to court.
In 2010, Mugadza was ordered by the Harare civil court to pay $160 per month towards the maintenance of his child.
He was ordered to pay his son’s school fees and buy clothes for the boy twice a year.
Despite the court order, the father of six defaulted resulting in arrears of $669.
Mugadza pleaded guilty when he appeared before Harare magistrate Tendai Mahwe who said as a first offender it was unfair to send the DJ to prison.
He then slapped him with a two months prison term which was wholly suspended on condition he pays the money on or before November 28.
In mitigation Mugadza pleaded for the court’s leniency arguing that he was married with six children who looked up to him.
Prosecutor Francesca Mukumbiri told the court that on July 6, 2010 Ngara took Mugadza to the civil court seeking an upward variation of maintenance for their son.
Mugadza was ordered to pay $160 per month for the child’s upkeep with effect from July 31 of the same year.
He was also ordered to pay the child’s school fees, to cater for all the school’s requirements and to buy him two pairs of casual clothes twice a year.
Mugadza failed to pay part of the child’s school fees amounting to $435 and did not buy textbooks for him.
He defied the court order by also failing to buy clothes for his son and to pay for his school trip.Advertisement
